Foreigners Buying Property in Hurghada & Getting Residency — Bilingual Legal Guide
A bilingual English/Arabic guide from a Hurghada property and residency lawyer: who can own, the legal steps from title check to Green Contract registration, and how property ownership links to an Egyptian residence permit.
Can a foreigner own property in Hurghada? Yes. Egyptian law allows non-Egyptians to own residential units in Hurghada and along the Red Sea coast, within limits set by law on the number and purpose of units. The legal question is never whether you may buy — it is whether the purchase is structured so that your ownership is provable and protected.
Step 1 — Check the title before paying. A real estate lawyer in Hurghada should confirm who legally owns the unit, whether the land and building are properly licensed, and whether there are mortgages, seizures or court cases on the property. This check happens before any deposit.
Step 2 — Review the contract. Developer and resale contracts are usually drafted in Arabic in the seller's favour. Ask for a bilingual contract that fixes the price schedule, delivery date, penalties for delay, exact specifications and the seller's duty to cooperate in registration.
Step 3 — Protect the signature, then register. Where full registration takes time, a suit for validity of signature (دعوى صحة توقيع) gives a court-confirmed date and signature. Full ownership is then registered at the Real Estate Registry (الشهر العقاري) as a Green Contract (العقد الأخضر) in the buyer's name — the strongest proof of ownership in Egypt.
Step 4 — Residency through property. Foreign owners can apply for an Egyptian residence permit based on property ownership, provided the unit meets the conditions and minimum value set by the authorities at the time of application. The file normally includes the passport, the registered or court-confirmed contract, proof of payment, photos and the application at the Passports and Immigration office. Conditions change, so we confirm current requirements before each filing.
Common mistakes: paying into a personal account, accepting a reservation form instead of a contract, signing an Arabic-only contract you cannot read, and relying on a power of attorney given to an agent without limits. Each of these can cost the whole investment.
