    FAQ

FAQ — Divorce Lawyer in Egypt

Can I get divorced in Egypt without traveling here?

Yes, it is possible to obtain a divorce in Egypt without your physical presence. You can grant a legalized Power of Attorney (POA) at the Egyptian embassy or consulate in your current country of residence. This document authorizes our legal team to file and complete all necessary divorce proceedings on your behalf. We will represent your interests fully throughout the entire legal process, ensuring all procedural requirements are met, from filing the initial petition to finalizing the divorce decree.

    What is Khul' (خلع)?

Khul' (خُلع) is a specific type of wife-initiated divorce under Egyptian law, empowering a wife to terminate her marriage. To initiate a Khul' divorce, the wife typically agrees to return her dowry (Mahr) to the husband. Following this, the court proceeds to dissolve the marriage. While the process can vary, it generally concludes within an average timeframe of 6-9 months, allowing the wife to seek an end to the marital union based on her desire.

Will my Egyptian divorce be recognized in my country?

In most situations, an Egyptian divorce judgment can be successfully recognized in your home country. To facilitate this, our office will undertake the necessary steps to legalize the divorce judgment. This involves obtaining official authentication from the Egyptian Ministry of Foreign Affairs (MOFA) and then from your country's embassy or consulate in Egypt. This legalization process ensures the judgment's validity abroad, enabling its proper registration and recognition within your jurisdiction.

What about custody of the children?

Under Egyptian law, the mother is generally granted custody of young children following a divorce, especially during their early formative years. The father is, however, typically granted comprehensive visitation rights to maintain his relationship with the children. When cases involve parents from different countries, specific legal considerations and handling are required to navigate the complexities of cross-border custody and visitation arrangements, which our firm is equipped to manage effectively.

How long does a divorce take in Egypt?

The duration of a divorce in Egypt depends significantly on the type and complexity of the case. Uncontested divorces, where both parties agree on terms, typically conclude within 2 to 4 months. Khul' divorces, initiated by the wife, usually take between 6 and 9 months to finalize. For fully contested divorces, involving disputes over issues like assets or children, the process averages between 12 and 18 months, as these require more extensive court proceedings and negotiations.
