Estate Liquidation (تصفية التركات) in Egypt: How Foreign Heirs Recover Their Share

After the Inheritance Declaration is issued, the real work begins: locating assets, settling debts, valuing properties and distributing shares. This article explains how estate liquidation (تصفية التركات) works in Egypt, how long it takes, and how foreign heirs can recover their inheritance even from abroad.

Estate liquidation — تصفية التركة — is the formal legal process by which an Egyptian court (or an appointed liquidator) collects the deceased's assets, pays the debts, and distributes the net estate among the legal heirs according to their court-determined shares.

The process begins with a comprehensive asset search. Our office conducts title searches at the Real Estate Registry across every governorate where the deceased may have owned property, queries banks via the competent court, checks vehicle and company records, and traces shares in private companies.

Debts and obligations of the estate must be settled before distribution: outstanding taxes, utility bills, mortgages, loans, and any legitimate claims by creditors. We negotiate settlements where possible to maximize the net amount distributed to the heirs.

If heirs disagree, or if some heirs have taken possession of assets without authority, partition lawsuits (دعوى قسمة) and recovery actions are filed. Egyptian law gives every legal heir a strong right to demand partition or sale-and-distribution of indivisible assets such as a single apartment or villa.

Timelines vary: a cooperative, well-documented estate can be liquidated in 4–8 months. Complex estates with disputes, hidden assets or multiple properties usually take 12–24 months. We provide a written timeline and cost estimate after the first review.

Foreign heirs from the UK, Germany, Russia, Italy and the Netherlands regularly recover their full share through our office without traveling to Egypt. With a properly legalized Power of Attorney, we manage every step — court, registry, banks, and final transfer of funds abroad.
